Daniel Smith | January Update

Just before Christmas I excitedly wrote, "Day 534 (Nov. 14, 2016) opened a new segment for this gallant warrior...his Appeal began. The Appellate process to overturn Daniel’s conviction is finally actually underway." Hope was finally budding...or so it seemed.

Today is Day 596 (Jan. 12, 2017) and the Appeal is on hold because the Appelate court (1) has refused to respond to a simple request by Daniel’s Attorney; and instead (2) has granted the Prosecution an-unlimited-extension-of time to respond to Daniel’s Appeal.

As my soul cried out this isn’t fair. It isn’t right. It isn’t just - I pondered: Why have hallowed words been ignored, man-handled and spat upon by our Criminal Justice System? "Justice delayed is justice denied!" said William E. Gladstone in the late 1800s. That’s more than 200 years ago. We can fly to the stars, manipulate DNA and communicate globally in seconds. But one critical flaw still hampers, humilates and overwhelms sincere and honest hearts worldwide. Justice is unjust.

Scottish poet Robert Burns might well have been also referring to Justice when he wrote, "The best-laid plans of mice and men often go awry." He only lived 37 years before his death in 1797. If he could witness Daniel’s case (and thousands more judicial cases) ~ the atrocious scandals called Justice he would turn over in his grave where he’s been for more than three centuries.

One survivor of the holocaust wrote: "There may be times when we are powerless to prevent injustice, but there must never be a time when we fail to protest." - Elie Wiesel.

Back at SeaTac Federal Detention Center Daniel is nearly beside himself knowing he is missing his youngest daughter’s life, Karis’ companionship and holding his grandchild. Parents are aging. Friends are ghosts. Freedom is a memory.

Please don’t say, "Oh what’s the use." Please don’t stop hoping. Please keep protesting. Please keep supporting Daniel. Please keep helping the ongoing needs of his family, his battle and pray unceasingly.

Emily Dickinson’s poetic thoughts seem fitting right here:

“Hope is the thing with feathers
That perches in the soul
And sings the tune without the words
And never stops at all.”
