Daniel Is AT HOME

Daniel is now in custody in his home. Though he is finally back home with Karis and Sabby the Bureau of Prisons (BOP) still controls his every move. Thus he has to give notice to request leaving the apartment: like for a job interview, going to church, shopping, or having someone visit, etc.

This custodial monitoring will last for four and a half (4 1/2) more months ~ probably until shortly after New Years 2019. Finally then ~ ~  he’ll be free other than reporting to his Parole Officer ~ for 4 additional years.

Supreme Court Appeal Update:

Daniel’s attorney detailed what's ahead:

"The Supreme Court is scheduled to conference Mr. Smith’s case on September 24. There is a possibility for one of three things to occur: (1) They could order the government to respond to the petition and make a decision after that (if a response is filed, the reply must be filed within 10 days and the Court needed not wait to consider the reply); (2) they could grant the petition on any or all questions raised; or (3) they could deny the petition for no reason at all. There are over 10,000 petitions filed each year, and out of those petitions, the Court only grants about 80 per year."

FDA Debars Daniel For Life:  Question & Opinion About Being DeBared for life.

One supporter misunderstood the FDA debarment order thinking the FDA was freeing Daniel to do as he chose in the drug industry. His attorney says that "the debarment means Daniel can NOT provide services in any capacity to any person that has an approved or pending drug product application...and that's for lifetime."

Though Daniel is on the way to a fresh new life the Food and Drug Administration is not wanting to leave him alone. They published an unbelievable blockade for his future in the National Archives, Federal Register. The Daily Journal of the United States Government:

"The U.S. Food and Drug Administration (FDA or Agency) is issuing an order under the Federal Food, Drug, and Cosmetic Act (the FD&C Act) permanently debarring Louis Daniel Smith from providing services in any capacity to a person that has an approved or pending drug product application."

Important Questions ~

Has Daniel Found Work Yet?

NO!!  Though he is diligently seeking employment. Daniel has nearly become hired but the Bureau of Prisons (BOP) precludes certain types of employment and so he is still searching. Frustration.

Will he be able to earn enough income to support himself and his family?

He is more than capable and eagerly wants to get started working. In next month's Update hopefully we'll have good employment news.

What will it take financially to help Daniel get through this transition time?

IMPORTANT:  Some have written "Why Does Daniel Still Need Donations?" Ponder please He is just searching, preparing and training for new employment; but will not receive income until he gets past the initial months. I know you folks will do your best to meet his necessary finances. ~ as you’ve always done.  It is critical that he receives enough help to get a fresh start ~ particularly since the Feds are strictly controlling everything he does for the first six (6) months. It will be very difficult, to say the least, during this time.

How then can he get the financial support to make it?

(1) For you awesome supporters who know his story well ~ Daniel is praying that you’ll consider adding a small amount to your donation (if possible). It will really make a big difference for him. From Daniel ~ ~ ~ FINALLY At Home ~ ~ ~

"Dear Friends & Family,

     I send my deepest thanks to all of you who wrote this last week regarding my father, Larry.  I was unable to send email from my phone at the halfway house, but I look forward to answering each one from a real computer now that I'm home.  I am happy to report that my Dad is doing much better.  He has been my best friend through all of this.  He is ... and always will be my hero.

     I have much to share with you all in the days to come and have begun to explore ways to do that.  I look forward to reconnecting in a more personal way with each of you, either by email, phone or newsletter in the near future.  I am so thankful for Jim Humble and the Genesis II Church for helping to keep us all connected over the last three years.

     Yesterday was my first official day home.  And while it was absolutely wonderful, it was also surreal.  I felt a bit like a fish out of water ... as if being in prison for three years had an institutionalizing effect.  Was I supposed to be somewhere else?  Reporting to someone?  Was I "out of bounds"?  Forgetting something?

     I slept well last night.  There were no loud intercoms, no keys or footsteps approaching my door, no flashlights shining in my eyes, or angry banging and shouting in the middle of the night.  At last, I could use the restroom in private and lie on the green grass under the maple tree and listen to the leaves rustling in the summer breeze.  

     Indeed it IS the little things.

     Today was Karis' birthday and it was a delight to be home for that.  Our daughter, Sabby, made a raw vegan salted carmel cheesecake to die for.  Not only have I missed the taste of cheesecake and real chocolate, I've missed a number of life's lovely celebrations ... the birthdays of loved ones, Christmases, Thanksgivings, Easters.  

     But not anymore!  I'm home to stay!  I'm SO home to stay, in fact, the requirements of my home-confinement for the next four months allow me only to leave my home for work search, employment, or a four hour social outing once every two weeks.

     While its blissful to be home, there is still a lot of work to do as I navigate the complexities of home-confinement and search for a means to support my family.  Although I have certain requirements I must fulfill, I remain open to ideas if anyone has any suggestions.

Brief Comments from Dad: 

While visiting with Daniel...in person...in the Halfway House was an astounding event, I didn't dream two weeks later I'd be spending 5 days in a hospital diagnosed with a stroke. But the symptoms brought me back to 50% the 2nd day and 95%+ on day 3. Then maintaining the 95% days 4 and 5 I was sent home.  I absolutely believe it was your prayers that produced the rapid turn around. THANK YOU SINCERELY.  My doctor has ordered an MRI subject to having a cardiologist shutting off my Defibrillator while the MRI is done and them immediately restarting it again.

During that halfway-house reunion with Daniel after a separation of more than three (3) years I was thrilled to meet my awesome Son entirely upbeat, positive and bearing zero grudges or resentment to the people or system who imprisoned him. This is extraordinary. This bodes well for his future. He is entirely committed to succeed. He can’t fail. He won’t fail.  He is going to continue being a hero for each of us. No doubt about it.
Meeting his financial needs, writing encouraging letters and praying earnestly are so appreciated! The love you’ve always displayed energizes him and gives him undying hope. May you and yours be wonderfully rewarded for doing so.
