Who is Daniel Smith

This Preview will bring you up to speed about a decade-long, Federal-storm-trooper assault on a humble, caring soul who sought only to help disease-stricken fellow humans worldwide.

Why Daniel Smith has become a hero for tens of thousands of suffering people throughout the globe: Daniel founded Project Green Life (PGL), an alternative health association that made the first professional grade MMS (Master Mineral Solution)  ~ making it available in over 160 countries between 2007 and 2011.

Out of the blue the U.S. Food and Drug Administration (FDA) began warning Daniel that they wanted the distribution of MMS to stop - immediately. Following legal consultation, Daniel wrote the FDA explaining how MMS was improving the health of multitudes around the world and asked them why they were making this demand. Silence. Daniel sent the document again. Continued silence. Daniel repeated a third time.

Rather than responding, the FDA initiated a year-long clandestine reconnaissance mission for the purpose of secretly securing search and seizure warrants aimed at putting PGL out of business in one fail swoop. It became obvious that this pursuit by the FDA was another example of a plethora of similar militant assaults on other Alternative Health companies and practitioners and in truth was a part of the agency's ongoing war against health freedom. In Daniel’s case they threatened him with 38 years in a Federal prison figuring Daniel would immediately close Project Green Life and thus block the distribution of MMS ever again.

Even though hundreds of users of MMS wrote the FDA declaring praises for the efficacy of MMS the FDA continued and intensified their unconstitutional actions. Daniel was arrested and charged with six felonies along with his wife and two employees. For what you ask? Helping people to get well.

Following a mockery of a trial in which Daniel was forbidden by the Judge to put on a defense he was convicted and sentenced to 51 months in a Federal Penitentiary. Even with this travesty-of-justice punishment the Prosecutor argued with the Judge demanding Daniel be sentenced to Life in Prison.

As you look through this fact-filled blog (StandByDaniel.com) you’ll suspect a scheming collusion between the FDA and gigantic International Pharmaceutical entities. Daniel was portrayed as a conniving, evil, greedy Snake-Oil profiteer. One Federal employee even said, "I consider you a Domestic Terrorist!" Really? C’mon. Get real.

Truth is stranger than fiction. Right? This blog ~ StandByDaniel.com ~ will answer this query.

Thinking Back

In last month’s update we learned the dismal decision the Judges of the 9th Circuit Court of Appeals made about Daniel’s Appeal. They denied it again. First back in December by a 3-Judge panel and in Feb. by all 29 Judges. I was stunned when the 9th Circuit Court Clerk wrote: "The full court has been advised of the Petition for Rehearing En Banc and no judge of the court requested a vote on the Petition...it is DENIED."

Well so ~ is there any hope left for Daniel? Or is he going to go through his life a convicted felon...for helping people? Every job he applies for he is a felon. Every house he tries to rent he is a felon. Every loan he applies for he is a felon. He can’t vote - he’s a felon. And he can’t dare miss a meeting with his parole officer...for years. Is there any thing else that could help him? Is there someway his conviction can still be overturned? What is left?

By the way ~ don’t think we’ve been sitting on our hands. We’ve been active behind the scenes. President Trump has been sent a special request (by an astute Daniel supporter) to release him. Another determined supporter contacted the President, his wife and some of his staff as well. So far we’ve received no response. I’m praying for one.

So...What IS LEFT? Looking Ahead

Daniel, with his super outlook, refuses to give up. He brought us current on the one procedural hope remaining: "So what's next ? My attorney is preparing to submit a Petition for Certiorari to the U.S. Supreme Court based upon these and other issues in which the panel -- or its clerk -- ignored the law. A review by the Supreme Court, however, is not an easy thing to acquire, but we will try, and by grace we may prevail." Will you pray with me for this?

Dear Friends & Family,

Its been another month and each one that goes by brings me closer to family and Home. Seeing my freedom in the offing brings a great joy and longing I can't describe.

A quick update: my attorney is still working on our Supreme Court petition. We are expectantly hopeful for a reversal but I will accept whatever the outcome because this journey has already been its own reward.

As many of you know by now, I like to communicate with music. One song that has remained with me for the length of this journey is "Through All Of It" (by Colton Dixon), and this is the first song I'd like to dedicate to all of you in this letter.

I feel so blessed and thankful, not only for this experience, which I look forward to sharing one day in more detail, but for all your love and support of myself and my family along the way. I'll never forget my first day standing in a line for the computer at the first prison. In the midst of all the culture shock and wondering how I had ended up here, one person on in the line informed me he'd previously used MMS to eradicate his prostate cancer while another told me his wife was using it for a skin condition. I marveled, asking myself what were the chances I would be given such a timely reminder of what a wonderful thing I have been given the opportunity to be a part of.

How Dad Views Daniel

Today Daniel has been behind bars for 1,062 days since his conviction. Plus he was in house curfew for years before the trial. How I grieve that this incredible, giving, caring, creative soul has indeed been caged. He deserves to be freed. Please uncage this eagle and let him fly once more.

Daniel Smith | February Update

Last month we asked you to sign a Petition pleading with all 29 Judges of the 9th Circuit Court of Appeals to overturn the 3-Judge panel’s denial of Daniel’s appeal. More than 3,000 of you signed. THANK YOU for doing so. So what decision did the 29 Judges make?

Did the 29 Judges read the Petition and send Daniel home? NO.

Did the 29 Judges order a new trial and send Daniel home in the interim? NO.

How many of the 29 Appellate Court Judges agreed that Daniel’s appeal must be heard again?

The Court clerk wrote these dreary words: "The full court has been advised of the Petition for Rehearing En Banc and no judge of the court requested a vote on the Petition...it is DENIED."

That’s right 29 Judges ignored both Daniel’s Appeal for a new hearing and the 3,000 signer Petition. What a travesty.

Well so what is left? Here is Daniel’s response:

Beloved Friends and Family,

My deepest and warmest thanks to all of you (literally thousands) who signed a recent petition to the Ninth Circuit Court of Appeals asking its judges to rehear my case. Alas, the panel's decision arrived last week: Petition for Rehearing DENIED.  True to form, there was no reason or analysis given. It was as if no one bothered to read -- or care -- that the panel had failed to address the most fundamental issues raised, effectively denying the right to an appeal, just as the district court had denied the right to present a defense at trial.

So what's next ? My attorney is preparing to submit a Petition for Certiorari to the U.S. Supreme Court based upon these and other issues in which the panel -- or its clerk -- ignored the law. A review by the Supreme Court, however, is not an easy thing to acquire, but we will try, and by grace we may prevail. The Ninth Circuit is the most overturned circuit in the nation, so perhaps the Supreme Court will, once again, overturn this denial.

Please don't mistake this report as a cause to be bitter or to rail against injustice. This has been the most brilliant journey and I would not trade it for anything in this life. I can see now it has worked -- and is continuing to work -- a noble purpose in me and hopefully all of us.

As we await now the rest of the story, I want to share with you my latest anthem... my theme song... hoping you'll have a listen... and maybe it will become yours too. Music helps me transduce this journey through emotion into learning and wisdom -- especially here in prison where comforts are so few, tenderness is unknown, and "inward" is the only place to go. Daniel concludes:

I AM alive - in large part because of each of you. I can't tell you how many times I've felt like giving up. YOU DID IT!

Congratulations and a big Thank You.

Daniel's Petition to reach all 29 Judges at the 9th Circuit Court of Appeals is now in their hands. Thanks to you ~ almost 3,000 supporters of Daniel signed the Petition.  In December we had asked for you, his family and friends from all around the world, to sign the petition to ALL of the 29 judges to reconsider a 3-Judge panel's recent denial of Daniel's appeal.

Thank you for accepting Daniel's fight as your own and together when we are a united voice hopefully we can help change the outcome of this miscarriage of justice.

As mentioned last month: Playing Devil's Advocate for a moment: Some of you might be asking: "Well isn't Daniel's sentence going to be done next year? Why not just wait it out?"

The hope is that if the 29 Judge majority rules in Daniel's favor, his felony convictions will be removed and he'll go home to his family sooner.  Also, if he wins, he won't be branded a "FELON" for the rest of his life, or have to spend four more years on probation. This could make a big difference in Daniel's life, but could also make a big difference in the world of natural health, because the FDA has sure been shutting down Alternative Health Stores, Naturopathic Doctors (even an Amish gentleman).   Ponder - should the Government shut down a Vitamin Store for suggesting that a customer try Vitamin C or a cleansing routine?

For that matter how many children selling Lemonade in front of their own home need to be hassled by local police? It is time...we the people stand up and be counted!

Special Message From Daniel

Dear Friends & Family,

     Where do I start?

     I recently received a copy of a Change.org petition for rehearing my case that many of you signed on my behalf.  I was deeply moved by all the signatures and comments.  Thank you.

     I have been sitting in an elevated state of gratitude, reading each of your names aloud, giving thanks for your support.  I find myself smiling each time I come across a familiar name... a long-time supporter, an old friend, a lost-but-not-forgotten family member, a PGL customer, old business partner, even the "Cookie Monster".

     I am told that the Ninth Circuit Court of Appeals has accepted the petition as an "amicus curea" ("friend of the court") brief, and has circulated it to all the judges.  This seems extraordinary and even hopeful.  You did this.  Thank you.

     This has been a difficult journey, but not without reward.  Although disappointed by the cursory denial of my appeal, it gave me occasion to consider something I had not deeply considered before... radical forgiveness.  I realized that I simply can't leave here without laying down every last petty resentment, even if I lose, because nothing is worth fracturing my soul, and I'm not leaving here the same person that came in.  I'm not wasting a precious day of this monastic retreat.

     Perhaps the most important thing I've learned is to "allow", and that changing the world begins first with changing myself.  It sounds simple, but its true.  Imagine the freedom I felt the day I woke up and realized I didn't have to change the world anymore.  At last, I could lay down my arms... arms against injustice, arms against tyranny, greed and corruption; no more political intrigue, no more righteous causes.  Freedom.

     It will have to be enough to just change me; that is all I've been given charge to do.  And that begins, I reckon, with radical forgiveness.  Radical forgiveness says I'm sorry... I forgive you... thank you... no matter who you are, or what you did, and especially if that who is you (me).

Continuing Needs and one seldom mentioned - which is timely - for those who can help...

You folks have cheerfully helped with Daniel and his family's needs. It is hard to figure out a way to say Thank You more vividly as I am overwhelmed by your loving and caring ways. I have no doubt you'll do so again. Thank you in advance!

Besides the needs of the family at home, his commissary, and printing and mailing costs one very important need is lurking overhead. Daniel's Fine. I'm looking at the current statement. Funny but they call the fine a Crime Victim Fund. Hmm...who are the crime victims in this?

We've made regular payments but the total still exceeds $11,000.  If just a few of you could see your way clear to help with a small chunk of this think of what it will mean to Daniel & his family. When he finally gets released he'll first have to live in a halfway house and find a job before they'll allow him to go home. I doubt they'll say "Take your time repaying the fine." ~ ~ ~ Thank you cherished ones for considering this.
